Waiver

I understand that classes at Butcher Shop Fitness may be physically strenuous and I voluntarily participate in them with full knowledge that there is risk of personal injury, property loss or death. Recognizing this risk, I hereby assume and accept any and all risk of injury, death, damage or theft of personal property while participating in classes. I do hereby, for myself and my heirs, executors, successors, guardians, representatives, administrators and assigns, minor children, and anyone for whom I am guardian, forever release and discharge  Butcher Shop Fitness, its respective affiliated organization, trustees, officers, directors, associates, agents and personnel, from any and all claims, demands, injuries, actions, suits, pursuits, costs, expenses, damages and liabilities arising out of, connected with or resulting from participation in classes or presence on the premises, including, without limitations, any bodily injuries, personal injuries, illness, death, disability, property damages or losses or other damages of any kind and description incurred as a result thereof, including but not limited to those caused by acts or omissions of Butcher Shop Fitness, and/or its trustees, officers, directors, associates, agents and personnel. I further agree for myself and my heirs, distributes, guardians, that should any claim for bodily injuries, personal injuries, illness, death, disability, property damages or losses or other damages of any kind and description for my participation in classes or my presence on the premises be prosecuted against Butcher Shop Fitness, I shall indemnify and hold harmless Butcher Shop Fitness from any and all such claims or causes of action by whoever made or whenever presented.

In the event of injury, accident and/or illness during my attendance of any class, I hereby authorize Butcher Shop Fitness to summon any and all professional emergency personnel to attend, transport and/or treat me, including physicians and dentists, duly licensed as doctors of medicines, doctors of dentistry or other such licensed technicians or nurses. I also consent to treatment methods including diagnostic procedures, treatment and operative procedures deemed advisable and necessary by, and to be rendered under the general supervision of, any licensed physician, surgeon, dentist, hospital, or other medical professional or institution duly licensed to practice in Ohio. I agree to bear the full costs of such treatment.

I am at least 18 years of age. I agree that this release is governed by the laws of the State of Ohio and is intended to be as broad and inclusive as is permitted by Ohio law, and that in the event any portion of this release is determined to be invalid, illegal, or unenforceable, the validity, legality and enforceability of the balance of the release shall not be affected or impaired in an way and shall continue in full legal force and effect. I understand that The Butcher Shop Fitness is relying upon this release, and I agree to be legally bound by this release. I have carefully read this release and I fully understand its contents. I have had ample opportunity to ask questions before signing this release I am aware that this is a release of liability, and I sign of my own free will.

In consideration of Butcher Shop Fitness, Ltd. allowing me to participate in their classes and other good and valuable consideration received, I irrevocably consent to, authorize and grant the right of The Butcher Shop Fitness, Ltd. the use of any pictures, video footage or audio recordings containing my name, image, likeness, persona and/or voice (“Works”) and grant Butcher Shop Fitness, Ltd., its subsidiaries, affiliates, and designees, without additional compensation, notice or approval, the unrestricted worldwide right to use, reproduce, distribute, publish, display, transmit, broadcast and perform publicly, now or in the future, the Works, in whole or in part, in any form, manner, media or technology now or hereafter known. Butcher Shop Fitness, Ltd. may, in its sole discretion, use any or all of the Works in connection with its valid business purposes including, but not limited to, public relations uses and the advertising, marketing and promotion of its classes, brands, businesses, and initiatives including, without limitation, usage on any or all of Butcher Shop Fitness, Ltd.’s brand website(s), YouTube, and on any social media sites (e.g., Instagram and Facebook).

I do, for myself, my heirs, my assigns, executors and administrators, and all others claiming by or through me, release and exempt Butcher Shop Fitness, Ltd., its parents, subsidiaries, affiliates, officers, directors, shareholders, employees and agents from any and all actions, claims and demands which I now have or may acquire in the future by reason of loss arising out of any claim involving the use of my image, likeness, persona and/or voice including, but not limited to, claims for invasion of privacy, violation of right of publicity, moral rights, defamation
